Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Chiseled mobile application ("App") or the website getchiseled.app ("Site"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these Terms, you must immediately stop using the App and Site.

These Terms constitute a binding legal agreement between you and Chiseled. We may update these Terms from time to time; continued use of the App after changes are posted constitutes your acceptance.

2. Eligibility

You must be at least 13 years of age (or 16 in the EEA) to use the App. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding contract. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Chiseled is a macro and calorie tracking application that provides:

  • Personalized TDEE and macro target calculations based on user-provided body stats and goals
  • AI-powered food photo analysis for calorie and macronutrient estimation
  • Daily food logging and nutritional tracking
  • Progress tracking including weight logs, physique scores, and calorie history
  • Apple Health integration for step-based calorie burn adjustment
  • Daily reminders and goal notifications

The App is designed for informational and personal fitness purposes only. It does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, or health regimen.

4. User Accounts

To use Chiseled, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate
  • Keep your password confidential and not share your account with any third party
  • Notify us immediately at support@getchiseled.app if you suspect unauthorized access to your account
  • Accept full responsibility for all activity that occurs under your account

We reserve the right to disable any account at any time if, in our sole judgment, you have violated any provision of these Terms.

5. Subscriptions, Free Trials & Billing

  • Free Trial: Chiseled Pro includes a 7-day free trial for new subscribers. The free trial begins upon confirmation of your subscription in the App Store. You will not be charged during the free trial period.
  • Paid Subscription: After the free trial, Chiseled Pro is billed at $9.99 per month (or equivalent local currency). Pricing may vary by region and is displayed in the App Store at time of purchase.
  • Billing: Payment is charged to your Apple ID account at confirmation of purchase and at the start of each renewal period.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Cancellation: You may cancel your subscription at any time via Apple ID Settings > Subscriptions. Cancellation takes effect at the end of the current paid period — you retain access until then. We do not issue partial refunds for unused subscription time.
  • Free Trial Cancellation: To avoid being charged, you must cancel before the free trial period ends. Failure to cancel before the trial ends will result in an automatic charge.
  • Price Changes: We reserve the right to change subscription pricing with at least 30 days' advance notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.
  • Refunds: All purchases are final and non-refundable except as required by applicable law or Apple's refund policies. To request a refund, contact Apple Support directly.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Use automated tools, bots, scrapers, or crawlers to access, monitor, or copy content from the App
  • Attempt to gain unauthorized access to any portion of the App, its servers, or any related systems or networks
  • Transmit any viruses, malware, or other harmful code
  • Interfere with or disrupt the integrity or performance of the App or its servers
  • Use the App to develop a competing product or service
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Collect or harvest any personal data of other users

7. Health & Nutritional Disclaimer

IMPORTANT: Chiseled is not a medical device, medical service, or healthcare provider.

All nutritional calculations (TDEE, BMR, macro targets) are estimates based on commonly accepted formulas including the Mifflin-St Jeor equation. Individual results will vary. These calculations are provided for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

You acknowledge that:

  • Calorie and macro calculations are estimates and not medically precise
  • AI food photo analysis provides estimates that may not be 100% accurate
  • You should consult a registered dietitian, physician, or qualified healthcare professional before beginning any new diet or fitness program
  • Chiseled is not responsible for any health outcomes resulting from your use of, or reliance on, any information provided by the App
  • Individuals with eating disorders, medical conditions, or special dietary needs should seek professional guidance before using this App

8. Intellectual Property

All content, features, functionality, design, code, text, graphics, logos, images, and branding within Chiseled are owned by or licensed to Chiseled and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may not:

  • Copy, reproduce, distribute, or publicly display any portion of the App
  • Create derivative works based on the App or its content
  • Use Chiseled's trademarks, logos, or branding without prior written permission
  • Remove or alter any proprietary notices or labels

9. User-Generated Content

Any content you submit to the App (including food log entries, photos, and profile data) remains yours. By submitting content, you grant Chiseled a worldwide, non-exclusive, royalty-free license to use, process, and store that content solely for the purpose of providing the App's services to you. We will never use your personal food logs or photos for marketing purposes without your explicit consent.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the App will be uninterrupted or error-free; (b) defects will be corrected; (c) the App or servers are free of viruses or harmful components; (d) the results obtained from use of the App will be accurate or reliable.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHISELED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use or inability to use the App
  • Any content obtained from or through the App
  • Unauthorized access to or alteration of your data
  • Health or physical outcomes resulting from following calculated nutrition targets
  • Any other matter relating to the App

In no event shall our total aggregate liability to you exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) $50 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless Chiseled and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the App; (c) your violation of any third-party right; or (d) any content you submit to the App.

13. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for any reason including but not limited to: violation of these Terms, conduct harmful to other users or to us, or inactivity. Upon termination, your right to use the App ceases immediately.

You may terminate your account at any time by emailing support@getchiseled.app. Termination does not entitle you to a refund of any prepaid subscription fees.

14. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

You and Chiseled agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration rather than in court, except that either party may bring a claim in small claims court if it qualifies.

Class Action Waiver: You agree to resolve disputes with us only on an individual basis. You may not bring or participate in any class, collective, consolidated, or representative proceeding.

Arbitration shall be conducted under the rules of the American Arbitration Association (AAA). The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You have the right to opt out of arbitration within 30 days of first accepting these Terms by emailing legal@getchiseled.appwith the subject line "Arbitration Opt-Out."

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent arbitration does not apply, you consent to personal jurisdiction in the state and federal courts located in Delaware.

16. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, you also agree to the following:

  • These Terms are between you and Chiseled only, not with Apple Inc.
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product liability claims or third-party intellectual property infringement claims related to the App
  • You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited persons list
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

17. Miscellaneous

  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Chiseled regarding the App and supersede all prior agreements.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
  • Force Majeure: We will not be liable for any failure to perform due to causes beyond our reasonable control.
